CHILD SUPPORT DIVISION’S SAFETY MEASURES
Once you share your safety concerns with the Child Support Division, staff may place a Family Violence Indicator on your case and send you a Request for Nondisclosure Form.
Family Violence Indicator (FVI)
The FVI alerts child support staff that your child support case must be handled cautiously because of family violence. The FVI will not close your case.
Once the FVI is placed on your case:
- When your child support order is being established, your case will be set for a court hearing instead of a negotiation meeting with the other parent.
- You and the other parent will discuss the terms of the child support order separately.
- A request may be made to the judge to determine if your contact information will be kept out of publicly available court documents. For more information about this, see Request for Nondisclosure Form.
To request the FVI be placed on your case, inform child support staff about your safety concerns at any time during the child support process.
If you answered ”yes” to any safety questions on your child support application, your case will automatically have the FVI.
Important! Even if the FVI is placed on your case, ask child support staff about what steps you can take to stay safe on your court date.
Request for Nondisclosure Form
If you submit an application for child support services and answer "yes" to any of the “Important Safety” questions, the case will be marked with a Family Violence Indicator and a Request for Nondisclosure form will be sent to you. Also, if you speak or chat with a child support staff member and mention your safety concerns at any point, you will receive this form.
The Request for Nondisclosure is used by a parent to document safety concerns. The child support staff may use the information in the nondisclosure form to ask the court to order restrictions on your contact information. In child support orders, the law requires that both parents update each other of their address and other contact information. If there are safety concerns with this contact information being provided to the other person, the court can order that this information not be required to be disclosed.
By completing the Request for Nondisclosure, you provide helpful information for the child support staff to show the court why your address and other contact information should not be included in the order. The court makes a decision based on the information provided by the child support staff and any witnesses who testify during a hearing, including you.
